These Terms and Conditions (“Terms”) govern the use of the services and website (https://www.midcityhr.com) provided by MidCity Handyman & Remodeling (“we,” “us,” or “our”). By accessing our website, engaging our services, or entering into any agreements with us, you agree to comply with and be bound by the following terms and conditions. - Any quotes provided for services are estimates based on the scope of work discussed. Any additional work requested may incur additional charges.
### **2. Quotes and Estimates**
All quotes or estimates provided by MidCity Handyman & Remodeling are based on the information available to us at the time and may change if the scope of work changes.
- **Estimates Validity**: Estimates provided are valid for 30 days unless otherwise stated. After this period, we reserve the right to adjust prices due to changes in material costs or other factors.
- **Changes in Scope**: Any changes in the scope of the project may result in additional fees. Any adjustments will be discussed and agreed upon in writing before the work continues.
### **3. Payment Terms**
Payment terms are as follows unless otherwise agreed upon in writing:
- **Deposit**: A deposit of up to 50% of the total project cost may be required before work begins.
- **Final Payment**: The remaining balance is due upon the satisfactory completion of the work. Invoices are due upon receipt unless otherwise agreed upon in writing.
- **Late Payments**: If any payment due to us is not paid within the agreed time frame, we reserve the right to charge a late fee of 1.5% per month on the unpaid balance, or the highest amount allowed by law, whichever is lower.
- **Non-Payment**: We reserve the right to cease work if any payment is overdue. We may also seek legal remedies, including filing a lien against the property.
### **4. Cancellation and Refunds**
- **Cancellations**: You may cancel or reschedule the services at any time, but doing so within 48 hours of a scheduled appointment may result in a cancellation fee of 20% of the project cost.
- **Refund Policy**: Refunds are only granted under specific conditions as outlined in our **No Refund Policy**, which allows for refunds only within 14 days of project completion for issues related to workmanship or materials, subject to inspection.
### **5. Responsibilities of the Client**
As the client, you are responsible for:
- Providing us with accurate information regarding the project, including any specific materials or finishes you prefer.
- Ensuring that the work area is accessible and free from hazards that may impede our ability to perform services.
- Securing all necessary permits (unless otherwise agreed upon in writing).
If you fail to meet these obligations, we may charge for delays or additional time spent on the project as a result.
### **6. Project Timelines**
We will make every effort to complete your project within the agreed timeline. However, unexpected delays may occur due to factors beyond our control, such as material shortages, inclement weather, or other unforeseen circumstances.
- We are not liable for delays caused by third parties or circumstances outside our control.
- If delays are anticipated, we will inform you promptly and work with you to adjust the schedule as necessary.
### **7. Warranties and Disclaimers**
MidCity Handyman & Remodeling warrants that all work performed will be free from defects in materials and workmanship for a period of 12 months from the date of completion, unless otherwise stated in a written agreement.
- **Exclusions**: This warranty does not cover issues caused by client-provided materials, improper use, lack of maintenance, or external factors (such as damage due to fire, flooding, natural disasters, etc.).
- **Remedies**: If a defect arises within the warranty period, we will either repair the defect at no cost to you or provide a refund for the portion of the work affected, at our discretion.
**Disclaimer**: We make no other warranties, express or implied, with respect to our services. Any implied warranties, including merchantability and fitness for a particular purpose, are hereby disclaimed to the fullest extent permitted by law.
### **8. Limitations of Liability**
To the fullest extent permitted by law, MidCity Handyman & Remodeling will not be liable for any indirect, incidental, or consequential damages arising out of the use of our services, even if we were advised of the possibility of such damages.
- **Maximum Liability**: Our maximum liability for any claim, including claims of negligence, breach of contract, or otherwise, shall not exceed the total amount you paid for the specific services provided under the contract.
### **9. Intellectual Property**
All content, logos, graphics, text, and other intellectual property used on our website or in relation to our services are the property of MidCity Handyman & Remodeling.

- **Venue**: Any legal actions or proceedings related to these terms shall be brought exclusively in the state or federal courts located in Buffalo, New York.
